This paper examines data privacy as a fundamental human right, about technological advancements and personal data accessed in crime surveillance. The right to private life guarantees for the subjects of law the right to decide what to disclose and what to keep private. In the age of modern technology and social media, it is not an easy quest to maintain a private life or for the state to guarantee the protection of privacy. However, data privacy rights can be restricted under legal provisions and for a legitimate purpose, in the context of a criminal investigation or for crime surveillance. This paper discusses the evolving concept of personal data in light of technological advancements, private data processing in mass surveillance, and the responsibility of state bodies to guarantee and protect data privacy. The findings, illustrated through ECtHR cases, raise concerns related to data privacy protection, which often is violated by law enforcement authorities or other private entities that retain and store personal data for crime-combating purposes, in lack of necessity, proportionality, or established mechanisms to protect personal data. The paper concludes with recommendations for finding the right balance between protecting data privacy and society’s welfare.
